RBC Games Mobile Application
Effective Date: January 1, 2025
This End User License Agreement ("Agreement") is a legal agreement between you and RBC Creations LLC. By downloading, installing, or using RBC Games, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.
By accessing or using the RBC Games mobile application ("App"), you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement and Terms of Service ("Agreement"). This Agreement is between you ("User," "you," or "your") and RBC Creations LLC ("Company," "we," "us," or "our").
If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to this Agreement on your behalf. Parents and guardians are responsible for supervising their children's use of the App.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices that you own or control, solely for your personal, non-commercial entertainment purposes.

The App features a virtual currency called "Bird Tokens" that can be earned through gameplay or purchased with real money. Bird Tokens can be used within the App for various features, including but not limited to: game retries, hints, power-ups, and other in-game benefits.
YOU ACKNOWLEDGE AND AGREE THAT:
All purchases of Bird Tokens and other in-app purchases are processed through the applicable platform (Google Play Store or Apple App Store). By making a purchase, you agree to the payment terms of the respective platform.
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE except as required by applicable law or the policies of Google Play or Apple App Store. Refund requests must be submitted through the respective platform according to their procedures.
We reserve the right to change the pricing of Bird Tokens and other virtual items at any time. Price changes will not affect purchases already completed.
The App is partially supported by advertising. By using the App, you agree to the display of advertisements, which may include interstitial ads between games, rewarded video ads, and banner advertisements. Advertisement frequency and type may vary.
The App may offer optional rewarded advertisements that allow you to earn Bird Tokens or other in-game benefits by watching video advertisements. Availability of rewarded ads is subject to advertiser inventory and is not guaranteed.
Users may purchase an "Ad-Free" upgrade to remove most advertisements from the App. This purchase:

The App and all content, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, audio, video, game designs, and the design, selection, and arrangement thereof) are owned by RBC Creations LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"RBC Games," "Bird Tokens," and all related names, logos, and product names are trademarks of RBC Creations LLC. You may not use such marks without our prior written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the App will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RBC CREATIONS LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless RBC Creations LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your violation of this Agreement, or your infringement of any intellectual property or other rights of any person or entity.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach this Agreement.
Upon termination:
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. In the event the App is discontinued, all virtual items, including Bird Tokens, will be forfeited with no refund or compensation.
This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to this Agreement or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution in the state or federal courts located in Connecticut.
We reserve the right to modify this Agreement at any time. Changes will be effective upon posting the updated Agreement within the App or on our website. Your continued use of the App after any modifications constitutes your acceptance of the revised Agreement.
For material changes, we will make reasonable efforts to notify you through the App or other means.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and RBC Creations LLC regarding the App and supersedes all prior agreements and understandings.
